Provisions Regarding Law Enforcement and Other Agents
The non-profit organization No Tan Lines Republic recognizes that law enforcement has the duty to enforce the law and investigate potential violations. However, the United States Constitution limits their rights to carry out certain actions without consent, particularly concerning the privacy that must be granted to a naturist and physiolatric association. We declare and warrant that if we are law enforcement officers or government agents of any kind, we are present at naturist gatherings or accessing the No Tan Lines Republic website, Cestlavielasvegas.com, solely in a private and individual capacity.
We further warrant that if this declaration proves to be false, it would indicate that we are conducting an investigation into the members of the association or the association itself without disclosing our official status or purpose. In such a case, our presence at C'est La Vie Las Vegas would constitute an intrusion into private spaces without consent, in violation of the Fourth Amendment of the United States Constitution. We also guarantee that we are present under the direction of our employer and acting within the scope of our employment. Damages
(a) We agree that the appropriate amount of liquidated damages for the illegal collection of evidence resulting in a judicial, civil, or criminal proceeding against any member of the non-profit association No Tan Lines Republic is five dollars multiplied by the number of residents of the county where the violation occurred. This amount reflects a reasonable estimate of compensatory damages related to the loss of privacy, including humiliation, emotional distress, the necessity of paying legal fees, loss of employment or advancement, and other damages whose precise evaluation is uncertain. This sum shall be paid to each beneficiary against whom a civil or criminal proceeding is initiated, including in the case of a search warrant. (b) If no legal proceedings are initiated but evidence is collected, we agree that the amount of liquidated damages shall be two dollars and fifty cents multiplied by the number of residents of the county, to be paid to each beneficiary named or described in the collected evidence. We acknowledge that the non-profit organization No Tan Lines Republic and all its members are affected by such a violation, particularly due to the loss of confidentiality and the fear that unjustified charges may be brought in the future.
A first payment of damages under this paragraph will not prevent further proceedings if charges are later filed against a beneficiary, but the amount already received will be deducted from any subsequent compensation.
PART 2: ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
I am aware that C’est la Vie Las Vegas is a members- naturist community managed by the nonprofit association No Tan Lines Republik, and I will not be offended by nudity.
I, the undersigned Guest, understand and acknowledge that my stay at the property located at C’est la Vie Las Vegas, 4153 woodcrest road, las Vegas, nv 89121, involves inherent risks, including but not limited to bodily injury, illness, death, property damage, or loss arising from the use of the Property, its amenities (e.g., pool, hot tub, stairs, kitchen appliances, outdoor areas, insect bites), or surrounding areas. These risks may result from my own actions or inactions, the actions or inactions of others, or the condition of the Property.
I voluntarily assume all risks, known and unknown, associated with my stay at the Property, including but not limited to risks of slips, falls, collisions, equipment failure, or other accidents. I understand that the Host does not provide supervision or security services and that I am responsible for my own safety and the safety of any minors or other guests accompanying me.
In consideration of being permitted to stay at the Property, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree not to sue Max and Corinne DUFLOO, No tan Lines Republik, their agents, representatives, or affiliates from any and all claims, demands, damages, costs, expenses, or liabilities arising out of or related to any injury (including death), illness, property damage, or loss that I may sustain during my stay at the Property, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, damages, or expenses (including attorney’s fees) arising out of my actions, omissions, or use of the Property, including claims brought by third parties or other guests accompanying me.
I certify that I am physically fit to participate in any activities at the Property and have not been advised otherwise by a qualified medical professional. In the event of an emergency, I authorize the Host or their representatives to secure medical treatment on my behalf, at my sole cost and expense. I agree that I am responsible for all medical expenses incurred as a result of any injury or illness during my stay.
I agree to comply with all rules, guidelines, and instructions provided by the Host regarding the use of the Property and its amenities. Failure to comply may result in termination of my stay without refund.
This Agreement shall be governed by and construed in accordance with the laws of Nevada, Las Vegas, Clark County, without regard to its conflict of laws principles. Any disputes arising under this Agreement shall be resolved in the courts of Las Vegas, Nevada.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
I have carefully read this Accident Waiver and Release of Liability Form, fully understand its terms, and sign it freely and voluntarily without any inducement. I am at least 18 years of age and have the legal capacity to enter into this Agreement.
